Rent review arbitration: the appointment and procedure explained

Land

This business guide explores the arbitration process by which rent can be reviewed if an agreement cannot be reached between the parties. It is the default method of determining rent reviews for Agricultural Holdings Act Tenancies (AHAs) and Farm Business Tenancies (FBTs).

Rent Reviews under FBTs that do not follow what is known as the “statutory procedure” may provide alternative dispute resolution procedures. These will be set out in the tenancy agreement and fall outside the scope of this guide.  Please see our separate business guide “Rent reviews for Farm Business Tenancies: understanding the procedure” for further information on the statutory procedure.
