Public rights of way: creation orders and agreements
Local authorities are able to enter into an agreement with landowners to dedicate a public right of way (PRoW) over their land for public use. This type of agreement is known as a Public Path Creation Agreement (or simply a “Creation Agreement").
The local authority can alternatively seek to create a new PRoW by applying for a Public Path Creation Order (or a “Creation Order”), which would not require the landowner’s agreement.
