Contracts for workers: written statements explained
Worker status is sometimes seen as a “half-way house” between employee and self-employed status. Workers are entitled to fewer statutory rights than employees. For more information on whether you are taking on an employee or worker please see our Business Guide: Employment Status which takes you through a checklist to help determine this.
There is a legal requirement to provide a worker with a written statement of employment particulars.
The Fair Work Agency (FWA) is a new UK government body which launched under the Employment Rights Act 2025. It will proactively enforce holiday pay, minimum wage, statutory sick pay, and labour abuses, directly impacting employment contracts by ensuring stricter compliance and enabling tribunal representation for workers. It is therefore vital that employment contracts are in place and compliant with the law.
This Business Guide (BG) provides you with guidance on what information must be included in the statement and seeks to answer some of the questions regarding your legal obligations.
